JOUNA · Legal information
Terms of Service
JOUNA is a platform operated by [RAZÓN SOCIAL], registered at [DOMICILIO LEGAL], tax identification [CUIT / NIF] ("JOUNA", "we", "us").
These Terms are the agreement between you and JOUNA for your use of the app and the website. By creating an account, booking an activity or publishing one, you accept what follows. If you disagree with any part of it, do not use the service.
1. What JOUNA is, and what it is not
JOUNA connects people looking for sports activities with the people who run them. We publish what each organiser enters, let you book it, and process the payment.
We do not teach the classes or run the events. The organiser does, and the organiser is responsible for what happens in them: the content of the activity, the competence of whoever leads it, the condition of the venue, any applicable insurance, and compliance with the rules that apply.
We also do not verify organisers’ qualifications, licences or certifications. That someone can publish on JOUNA does not mean we have vetted or endorsed them.
2. Your account
You need an account to book or to publish. You can create one with your email and a password, or by signing in with Google or Apple.
The details you provide must be accurate and current. You are responsible for what happens under your account and for keeping your password private; if you think someone accessed it without your permission, write to us.
An account is personal. Do not share it or transfer it.
3. Minimum age
The service is intended for people aged 18 or over. If you are between 16 and 18, you may use it with the authorisation of whoever holds parental responsibility for you, who accepts these Terms together with you.
It is not intended for anyone under 16. If we find an account belonging to someone below that age, we close it.
When you accept these Terms in the app, you state that you meet this condition.
4. Bookings
Every activity shows its date, place, price, remaining spots and the cancellation policy that applies, before you confirm. When you book, those conditions are fixed for that booking: if the organiser changes their policy afterwards, your booking is still governed by the one you saw.
Capacity is firm. Once an activity fills up, the platform stops accepting bookings for it.
A booking is an agreement between you and the organiser. JOUNA facilitates and records it, but is not a party to it.
5. Prices, payments and service fee
The organiser sets the price. It is shown in Argentine pesos, including any taxes that apply.
Payments are processed by Mercado Pago, which has its own terms that you accept when you pay. JOUNA does not store your full card details.
If a payment does not go through, the booking is cancelled and the spot is released automatically.
JOUNA may charge a service fee on bookings and fees. Where one applies, it is disclosed on the platform before you publish or book, as the case may be, and Mercado Pago takes it off in the same charge. Changes to it are announced with reasonable notice and never applied retroactively to bookings already made.
6. Cancellations, refunds and credit
Each organiser defines their own cancellation policy, with tiers based on how far in advance the cancellation happens. That policy decides whether a cancellation returns money, grants credit, or returns nothing.
If the organiser cancels the activity, everyone booked is notified and gets back what they paid, as money or as credit depending on the organiser's policy.
JOUNA's service fee is borne by the organiser: it is never added to what you pay nor taken off a refund. Whatever the reason for a refund (a cancellation, an organiser's decision or a duplicate payment), it is worked out on what you paid and, after every refund, the app shows you the amount refunded and what it is for.
Where a refund is settled as credit, that credit is held in your favour against that organiser and can be used on their future activities. It is not money, it is not transferable to another organiser, and it is not converted to cash, unless the law applicable to your case says otherwise.
Cash refunds go back to the original payment method through Mercado Pago. Some organisers choose to make refunds directly, and sometimes Mercado Pago cannot process one (for example, when the organiser's account has no balance). In those cases the cancellation goes ahead all the same, the organiser makes the refund directly, and the app tells you the amount and how to reach them.
In refunds, JOUNA acts as an intermediary between you and the organiser. When a refund is the organiser’s to make, JOUNA may notify them, follow up, collect your feedback on how it was resolved and apply measures to them on the platform, including those in section 12. JOUNA is not responsible, nor jointly liable, for refunds an organiser owes.
How long a cash refund takes to appear depends on the payment method and the provider, not on JOUNA.
7. If you organise on JOUNA
Publishing commits you to a few concrete things, in addition to everything above:
- Describe each activity accurately: what it is, where, when, what level it requires and what it includes.
- Hold the licences, insurance and authorisations your activity and your jurisdiction require.
- Assign a contact person before publishing. The platform does not allow publishing without one.
- Stand behind what you published: if you cancel, apply your policy and notify people.
- Make the refunds that are yours to make. If you handle refunds yourself, or Mercado Pago cannot process one, the refund is your obligation: make it and mark it as done in the app. JOUNA may notify you, follow up, collect feedback from the person waiting for it and apply measures on the platform if you do not. While a refund has been pending for 10 days or more, your organisation cannot publish new paid classes.
- Respect the capacity you set. You cannot reduce it below the number of people already booked.
- Answer for your team. If you add people with admin or staff roles, their actions inside your organisation are your responsibility.
- Meet your own tax obligations on what you charge. JOUNA does not act as your withholding agent except where the law requires it.
8. Conversation mode
If you organise, you can use conversation mode: a feature of the app that puts together proposals for managing your organisation from what you ask for in your own words. What you can ask for depends on your role and on the actions the app offers.
Conversation mode proposes and you confirm. Nothing is created, changed or sent without your confirmation, and what you confirm is your content and your decision, with the same obligations under section 7 as if you had entered it from the app’s screens. A proposal may contain mistakes: check it before confirming.
Proposals are put together by an artificial intelligence service from one of the language-model providers on the public list of providers (www.jouna.app/ar/en/providers). JOUNA may use, alternate between or replace providers on that list to keep the feature available. Adding a new one is announced in advance, as that page explains.
By using it you accept the conversation mode Usage Policy (www.jouna.app/ar/en/usage-policy), which is part of these Terms. It says what you can and cannot ask for, the usage limits, and the measures if it is not complied with, including suspending the feature for a person or for an organisation.
Do not write other people’s personal data in a request when it is not needed, especially about their health or about minors. The app removes what it detects before the request is processed, but no filter detects everything.
The data of your members and of the people who book that is used to carry out what you confirm (for example, who a notice goes to) is not sent to the language-model providers, and is processed under the Privacy Policy.
Conversation mode may be unavailable at times, for example if the providers do not respond or a usage limit is reached. Everything it does can be done from the app’s screens. If we stop offering it, we give advance notice in the app and by email.
9. Content you publish
You remain the owner of the text, photos and video you upload. By publishing them, you grant us a free, non-exclusive, worldwide licence to display, reproduce and technically adapt them in order to operate and promote the platform, including promoting your own activities.
That licence lasts while the content is published, and survives for the reasonable time it takes to remove it from backups and from material already distributed.
You warrant that you hold the rights to what you upload, including the consent of any identifiable people appearing in it.
10. Conduct
While using JOUNA, you may not:
- Publish activities that are false, misleading, or that you do not intend to run.
- Impersonate another person or organisation.
- Harass, threaten or discriminate against anyone.
- Publish content that is offensive, obscene, or that incites hatred or violence.
- Use the platform for illegal activity, or to offer services other than those JOUNA is for.
- Attempt to access other people’s accounts, or parts of the service that are not yours.
- Extract data from the platform by automated means without our written permission.
- Circumvent the payment mechanisms in order to move the transaction off the platform.
11. Reviews and moderation
Anyone who attended an activity can leave a review. Reviews are the opinion of whoever wrote them, not of JOUNA.
You can report content or conduct that breaches these Terms. We review every report within 24 hours of receiving it and may remove content, limit features or suspend accounts where warranted.
Any review can be reported from the class page. If a review breaches these Terms, we may hide its text; its rating stays. A review reported by several people has its text hidden until we finish reviewing it.
You can block the person who wrote a review: you stop seeing their reviews anywhere in the app. The review stays visible to everyone else. You can unblock that person at any time from your profile.
We do not edit reviews to improve an organiser’s image, and we do not remove them for being negative.
12. Suspension and closure
We may suspend or close an account that breaches these Terms, that creates a risk to other people, or that the law requires us to suspend. Unless it is urgent or the law prevents it, we tell you and we tell you why.
You can close your account at any time from the app. Doing so deletes your notifications, your saved activities and your registration for push messages.
Bookings and reviews are not deleted: they are detached from your identity and no longer carry your name. This is what lets an organiser keep the record of what happened in their activities, and keeps their rating from changing because someone closed an account.
Closing an account does not by itself cancel active bookings or outstanding payment obligations.
13. Physical activity and risk
Physical activity carries risk, and some of the sports published on JOUNA carry more than others. You take part at your own risk.
You are responsible for judging whether you are fit to do an activity, and for consulting a health professional if you are unsure. JOUNA does not assess your fitness or anyone else’s.
Before taking part, tell the organiser about any relevant condition, and follow their instructions during the activity.
14. Warranties and liability
The platform is provided as is. We work to keep it running and available, but we do not guarantee it will be free of interruptions or errors.
JOUNA is not liable for what happens during an activity, or for harm arising from it: that is the organiser’s responsibility. Nor are we liable for the conduct of other users, for the content they publish, or for refunds an organiser owes (section 6).
To the extent the law allows, our total liability to you for any claim connected to the service is limited to the amount you paid through JOUNA in the twelve months before the event giving rise to it.
None of this limits liability that the law does not allow to be limited, including liability for wilful misconduct or gross negligence, or arising from consumer protection rules that apply to you.
15. Indemnity
If a third party brings a claim against JOUNA because of something you did in breach of these Terms — including an activity you published or content you uploaded — you take on that claim and the reasonable costs it causes us.
16. Intellectual property
The JOUNA name, the logo, the design of the app and the website, and the software are ours. Do not use them without written permission, beyond what is needed to use the service normally.
17. Changes to the service and to these Terms
We may change the platform, and we may update these Terms. Where a change is material, we give reasonable notice and ask you to accept the new version inside the app.
Every version carries its number and its date. The version in force is the one published on this page.
If you do not accept a new version, you can stop using the service and close your account. Bookings made under the previous version remain governed by it.
18. Governing law and jurisdiction
These Terms are governed by the law of the place where JOUNA is established, with its registered office in [CIUDAD, PAÍS], and any dispute is submitted to the courts of that jurisdiction.
If you are a consumer, this does not deprive you of the protection of the mandatory rules of your country of residence, or of bringing a claim before the courts those rules entitle you to.
19. Contact
For anything about these Terms, write to hola@jouna.app or to [RAZÓN SOCIAL], [DOMICILIO LEGAL].
